These Terms and Conditions govern your use of timekeepen's website and services. By accessing our website or using our services, you agree to be bound by these terms. Please read them carefully.
1. Definitions
"Service" refers to watch repair, restoration, and customization services provided by timekeepen.
"User" or "Client" means any person or entity accessing our website or using our services.
"Timepiece" refers to any watch, clock, or timing device submitted for service.
"We," "Us," or "Our" refers to timekeepen, located at 1245 West Broadway, Vancouver, BC V6H 1G7.
"Website" refers to our online presence and all associated pages and services.
2. Use of Services
2.1 Eligibility
Our services are available to individuals who are at least 18 years of age and legally capable of entering into binding contracts under applicable law. By using our services, you represent that you meet these requirements.
2.2 Service Agreement
When you submit a timepiece for service, you enter into an agreement with timekeepen. We will provide a detailed estimate including scope of work, expected costs, and anticipated timeline before beginning any service. Your acceptance of this estimate constitutes agreement to these terms.
2.3 Accurate Information
You agree to provide accurate and complete information about your timepiece, including its history, known issues, and any previous repairs. Withholding relevant information may affect our ability to properly service your watch.
3. Client Responsibilities
As a client of timekeepen, you agree to:
- Provide accurate contact information for communication regarding your service
- Disclose all known issues, modifications, or repairs previously performed on your timepiece
- Remove valuable personal items before submitting your watch for service
- Respond to communication requests within reasonable timeframes
- Make payment promptly upon completion of approved services
- Collect your timepiece within 90 days of notification that service is complete
- Review and approve estimates before work proceeds
4. Service Terms and Limitations
4.1 Service Estimates
All service estimates are provided in good faith based on initial assessment. If unexpected issues are discovered during service, we will contact you with revised estimates before proceeding with additional work.
4.2 Timeframes
Service timeframes are estimates and may be adjusted based on parts availability, complexity of work, or other factors beyond our control. We will communicate any significant delays promptly.
4.3 Parts and Materials
We make reasonable efforts to source appropriate replacement parts. For vintage watches, period-appropriate alternatives may be necessary when original parts are unavailable. We will discuss alternatives before using them.
4.4 Service Scope
Services performed are limited to those specifically agreed upon in the estimate. We reserve the right to decline service on timepieces requiring expertise or equipment we do not possess.
5. Warranties and Disclaimers
5.1 Service Warranty
We warranty our workmanship for six months from service completion. This warranty covers defects in our work but does not cover damage from misuse, accidents, or normal wear. Warranty repair requires return of the timepiece to our facility.
5.2 Parts Warranty
Replacement parts are covered by manufacturer warranties where applicable. We pass through any applicable warranties but are not responsible for parts failure beyond our control.
5.3 Disclaimer
Services are provided based on the condition of your timepiece at intake. While we exercise care and skill, we cannot guarantee specific outcomes, especially for vintage pieces with unknown service history. Watch repair involves inherent challenges, and results may vary based on the watch's condition, age, and complexity.
5.4 No Guarantees of Value
We make no representations regarding the market value or collectability of timepieces we service. Values can change, and service may or may not affect a watch's market value.
6. Limitation of Liability
6.1 Maximum Liability
Our maximum liability for any claim related to services provided shall not exceed the amount paid for those specific services, or CAD $2,500, whichever is less, unless otherwise required by applicable law.
6.2 Indirect Damages
We are not liable for indirect, incidental, consequential, or special damages including but not limited to loss of use, loss of profits, or sentimental value, even if we have been advised of the possibility of such damages.
6.3 Client Responsibility
Clients assume responsibility for risks associated with watch repair, particularly for vintage, rare, or highly valuable timepieces. We recommend discussing insurance options for high-value items.
7. Payment Terms
Payment for services is due upon completion unless other arrangements have been made in writing. We accept cash, credit cards, and bank transfers. A deposit may be required for extensive restorations or custom work. Prices are quoted in Canadian dollars and are subject to applicable taxes.
If payment is not received within 30 days of service completion notification, we reserve the right to charge interest at the rate of 2% per month on the outstanding balance. After 90 days, unclaimed timepieces may be sold to recover costs, with any excess proceeds held for the owner.
8. Intellectual Property
All content on our website, including text, images, logos, and design elements, is the property of timekeepen or our licensors and is protected by copyright and other intellectual property laws. You may view and use website content for personal, non-commercial purposes only.
You may not reproduce, distribute, modify, or create derivative works from our website content without express written permission. Documentation and photographs of your timepiece created during service remain our property but may be shared with you for your records.
9. Dispute Resolution
9.1 Informal Resolution
In the event of any dispute, we encourage you to contact us first to seek informal resolution. Most concerns can be addressed through direct communication.
9.2 Mediation
If informal resolution is unsuccessful, parties agree to attempt mediation through a mutually acceptable mediator before pursuing other remedies.
9.3 Governing Law
These terms are governed by the laws of British Columbia and Canada. Any legal action must be brought in the courts of British Columbia.
9.4 Time Limit for Claims
Any claim related to our services must be brought within one year of service completion or the claim is waived.
10. Changes to Terms
We reserve the right to modify these Terms and Conditions at any time. Changes will be effective upon posting to our website with an updated "Last Updated" date. Material changes will be communicated through prominent website notice.
Your continued use of our services after changes take effect constitutes acceptance of the modified terms. We recommend reviewing these terms periodically.
11. General Provisions
11.1 Entire Agreement
These Terms and Conditions, together with any service estimates and agreements, constitute the entire agreement between you and timekeepen regarding use of our services.
11.2 Severability
If any provision of these terms is found to be unenforceable, the remaining provisions will continue in full force and effect.
11.3 No Waiver
Our failure to enforce any right or provision of these terms does not constitute a waiver of that right or provision.
11.4 Assignment
You may not assign or transfer your rights or obligations under these terms without our written consent. We may assign our rights and obligations without restriction.
